Terms of Service

Welcome to ZeroToArchitect. These Terms of Service ("Terms") govern your access to and use of the ZeroToArchitect website, platform, and services (collectively, the "Service") provided by Tepes-Paleu George-Alexandru, a Persoană Fizică Autorizată (PFA) registered in Romania.

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and ZeroToArchitect. Please read them carefully before using our Service.

The Service is provided by:

ZeroToArchitect provides an online educational platform offering:

• Software architecture courses and learning materials
• Interactive coding exercises and challenges
• Certification programs and exams
• Progress tracking and analytics
• Community features and discussion forums
• Premium content and subscriptions

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, for any reason including but not limited to maintenance, improvements, or changes in business strategy.

4.1 Account Creation

To access certain features of the Service, you must create an account by providing:

• A valid email address
• A secure password
• Your name and any other required information

You must be at least 16 years old to create an account. If you are under 16, you may only use the Service with the consent and supervision of a parent or legal guardian.

• Circumvent payment systems or access restrictions

6.1 Our Content

All content on the Service, including but not limited to text, graphics, logos, videos, courses, software, and code examples (collectively, "Content"), is owned by or licensed to ZeroToArchitect and is protected by Romanian and international copyright, trademark, and other intellectual property laws.

6.2 License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Service for personal, non-commercial educational purposes
• View and interact with course content you have purchased or have access to
• Download course materials solely for personal learning (where explicitly permitted)

6.3 Restrictions

You may NOT:

• Copy, modify, or distribute our Content without written permission
• Create derivative works based on our Content
• Reverse engineer, decompile, or disassemble any software
• Remove copyright notices or proprietary markings
• Share course content with non-enrolled users
• Use our Content for commercial training or teaching without a license

6.4 User-Generated Content

If you submit content to the Service (comments, forum posts, code submissions), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with the Service.

You retain ownership of your user-generated content, but you represent that you have the right to grant us this license and that your content does not violate any third-party rights.

7.1 Pricing

Certain features of the Service require payment. All prices are displayed in the applicable currency and may be subject to change with reasonable notice.

7.2 Payment Processing

Payments are processed securely through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms and conditions. We do not store your complete payment card information.

7.3 Subscriptions

For subscription-based services:

• Subscriptions automatically renew unless cancelled before the renewal date
• You will be charged the then-current subscription price upon renewal
• You can cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods

7.4 Refund Policy

We offer refunds within 14 days of purchase for one-time course purchases if:

• You have not completed more than 30% of the course content
• You have not obtained a certificate or credential
• The request is made in good faith (not to abuse the system)

Refund requests must be submitted to contact@zerotoarchitect.com. We reserve the right to deny refund requests that do not meet these criteria.

7.5 Taxes

Prices may not include applicable taxes. You are responsible for any sales tax, VAT, or other taxes required by Romanian or international law. We will add applicable taxes to your invoice where required.

8.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination:

• You will lose access to all content and progress
• Subscriptions will not renew if cancelled before the next billing date
• You remain responsible for any outstanding payments

8.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice or liability, if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Fail to pay required fees
• Create security risks or legal exposure for us or others

8.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, limitation of liability) will remain in effect.

9.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantee

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Course content will meet your specific career or educational goals
• All errors or defects will be corrected
• The Service will be compatible with all devices or software

9.3 Educational Content

While we strive for accuracy, we do not guarantee that course content is complete, current, or error-free. Educational content is for informational purposes and should not be considered professional advice.

9.4 Employment Outcomes

We make no guarantees regarding employment, career advancement, salary increases, or any other professional outcomes as a result of using our Service.

TO THE MAXIMUM EXTENT PERMITTED BY ROMANIAN AND EU LAW, ZEROTOARCHITECT SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses
• Any damages resulting from your inability to access or use the Service
• Any unauthorized access to or alteration of your transmissions or data
• Any content or conduct of any third party on the Service
• Any loss of learning progress or user-generated content

10.1 Maximum Liability

Our total liability to you for all claims arising from or related to the Service shall not exceed the greater of:

• The amount you paid us in the 12 months preceding the claim, or
• €100 (one hundred euros)

10.2 Applicable Law

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations above may not apply to you to the extent prohibited by law.

You agree to indemnify, defend, and hold harmless ZeroToArchitect, its affiliates, officers, employees, agents, and service providers from any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your user-generated content
• Any breach of your representations and warranties

This indemnification obligation will survive the termination of these Terms and your use of the Service.

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

12.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Romania.

12.3 EU Users

If you are a consumer in the European Union, you may also have the right to bring proceedings in your local courts under EU consumer protection laws.

12.4 Informal Resolution

Before filing any formal claim, we encourage you to contact us at contact@zerotoarchitect.com to seek an informal resolution. Most disputes can be resolved quickly and amicably through direct communication.

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via email or a prominent notice on the Service
• Provide you with reasonable advance notice before the changes take effect

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

We recommend reviewing these Terms periodically to stay informed of any updates.

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ZeroToArchitect regarding the Service and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, government actions, or internet service provider failures.

14.6 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version shall prevail.
